Difference Between DUI & DWI Under Texas Law

Although a DWI charge applies to both minors and adults, a DUI charge applies only to minors under the age of 21.  However, a person under 21 years of age can also be arrested for a DWI.  The question as to whether a minor will be charged with a DUI or a DWI depends on the amount of alcohol or drugs in the person's system at the time of the arrest.  If the minor blows into a breathalyzer and it comes back with a Blood Alcohol Content (BAC) of 0.08 or more, than you will be arrested for a DWI.  There are other ways law enforcement use to help determine a person's level of intoxication.  These can be found at our DWI page.
